Negligent Security

As any Las Vegas attorney can tell you, inadequate or Negligent Security by an individual or company which owns or controls property can drastically change the rest of one’s life in an instant. If you were criminally attacked or became the victim of a third party’s intentional conduct on someone else's property, you may have a claim for Inadequate or Negligent Security. The basic legal standard in these cases generally is whether a foreseeable danger exists.  Many of the factors contributing to whether a danger is foreseeable include (1)  whether there is specific knowledge of the threat of the attack before its occurrence; (2)  the incidence of prior crimes, both violent crimes and other types of crimes, on the property or in the vicinity of the property; (3) when looking at all of the facts and circumstances of the attack, including the type of property or business, its hours of operation, whether alcohol is served on the premises and the incidence of prior criminal activity on or near the property, it is likely that such an attack will occur; and, (4)  balancing the duty of the property owner or the management of the property to use adequate security measures and the cost of such measures against the harm likely to occur to innocent victims if the measures are not employed. 

A list of some, but certainly not all, of the types of Negligent Security cases which we have handled at Douglas H.
